Website Terms of Use

Dinah Rainey Law, LLC | Updated October 11, 2026

Effective date: October 12, 2026

1. Acceptance and Scope

These Terms of Use (“Terms”) govern access to and use of dinahraineylaw.com and its pages, articles, forms, newsletters, graphics, and downloadable resources (the “Website”), operated by Dinah Rainey Law, LLC (the “Firm,” “we,” or “us”). By accessing or using the Website, you agree to these Terms. If you do not agree, discontinue use. The Website and the Firm’s legal services are intended primarily for adults and businesses. If you are under 18, please have a parent or legal guardian contact the Firm on your behalf regarding potential legal services. Minors may have trademark ownership interests; this provision does not determine who may own a trademark or whether the Firm may accept a particular matter.

2. Informational Content and No Legal Advice

The Website provides general information about trademarks and the Firm’s services. Its content is not individualized legal advice and is not a substitute for advice concerning your circumstances. Laws, procedures, government fees, and agency practices can change. Although we seek to provide useful, accurate information, we do not guarantee that Website materials are complete, current, or applicable to a particular matter.

3. No Attorney-Client Relationship; Communications

Visiting the Website, reading or downloading materials, subscribing to emails, sending an inquiry, or scheduling or attending an initial consultation does not, by itself, create an attorney-client relationship. The Firm evaluates prospective matters, including potential conflicts, before deciding whether to accept representation. Please do not send sensitive or confidential information through general Website forms or unsolicited email. When appropriate, we will provide instructions for sharing information securely. Communications from prospective clients may be subject to duties imposed by applicable professional-conduct rules, regardless of whether representation begins. Nothing in these Terms limits those duties.

4. Practice and Jurisdiction

Dinah Rainey is licensed to practice law in Georgia. The Firm offers legal services in federal trademark matters before the United States Patent and Trademark Office to eligible clients nationwide, subject to applicable law and professional rules. Nothing on the Website is an offer to provide legal services in a jurisdiction or matter in which doing so would be unauthorized.

5. Services, Fees, and Engagement Agreements

Descriptions of services and any Website pricing are informational and are not a binding offer or fee agreement. Not all services or fees are listed on the Website. Scope, attorney fees, applicable government fees, payment arrangements, and any refund or unearned-fee treatment will be addressed in the applicable written engagement agreement and under governing law. Any executed engagement agreement controls the attorney-client relationship and prevails over these Terms in the event of conflict. These Terms do not modify or replace an engagement agreement.

6. Rules for Using the Website

You agree not to: (a) use the Website for unlawful, fraudulent, abusive, harassing, defamatory, or infringing purposes; (b) transmit spam, malware, malicious code, or unauthorized promotional material; (c) attempt to gain unauthorized access to the Website, its accounts, systems, or data; (d) disrupt or interfere with Website operations or security; (e) impersonate another person or misrepresent your identity; or (f) reproduce or commercially exploit Website content except as permitted in these Terms or by law.

7. Intellectual Property Ownership

Unless otherwise indicated, original Website text, branding, graphics, designs, and resources are owned by the Firm or used with permission from their respective owners. The Website and its content may be protected by copyright, trademark, and other applicable laws. Nothing in these Terms transfers ownership or grants rights in Firm names, logos, or marks.

8. Limited License; Sharing Content

We grant you a limited, revocable, nonexclusive, nontransferable license to access the Website and to view or download resources for lawful personal or internal business informational use. You may share links to public Website pages with appropriate attribution. You may not sell, republish, alter, distribute, or commercially exploit substantial Website content without prior written permission, except where allowed by law.

9. Information Submitted to the Firm

You represent that you are authorized to provide information you submit through Website forms or other communications. You authorize the Firm and its service providers to process and use that information as reasonably necessary to respond to your inquiry, evaluate possible representation, administer requested communications, or provide services you have requested, subject to applicable confidentiality and privacy obligations. Submission does not grant the Firm ownership of your documents or permission to publish, market, or otherwise exploit confidential or client information.

10. Third-Party Websites and Services

The Website may contain links to outside websites or use third-party providers for scheduling, client intake, portals, payments, and email delivery. Third parties may have their own terms and privacy practices. Links are provided for convenience and do not necessarily constitute endorsements. We do not control external websites and, to the extent permitted by law, are not responsible for their independent content or operations.

11. SMS Messaging

Dinah Rainey Law, LLC has the following SMS messaging terms:

a. The messaging program consists of general conversational messaging to answer questions and provide support to customers.

b. You can cancel the SMS service at any time. Just text ‘STOP’ to the phone number from which you received messages. After you send the SMS message ‘STOP’ to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

c. If you are experiencing issues with the messaging program you can reply with the keyword HELP for more assistance, or you can get help directly at [email protected].

d. Carriers are not liable for delayed or undelivered messages.

e. As always, message and data rates may apply for any messages sent to you from us and to us from you. Message frequency will vary based on communication needs. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

f. If you have any questions regarding privacy, please read our privacy policy contained in the rest of this document/page.

12. No Promises Regarding Outcomes or Testimonials

Any descriptions of matters, examples, or testimonials appearing on the Website are illustrative only. They do not promise or guarantee any particular trademark-search conclusion, application outcome, registration, timing, or other result. Outcomes depend on the facts and applicable law.

13. Website Availability; Errors and Omissions; Warranties

We may change, suspend, or discontinue Website content or features at any time. We make reasonable efforts to maintain the Website, but cannot promise uninterrupted access, error-free operation, or that all information will remain up to date. To the extent permitted by law, the Website and general informational materials are provided “as is,” without warranties of availability, accuracy, completeness, or fitness for a particular purpose. This provision does not disclaim duties arising from an attorney-client relationship.

14. Website-Related Limitation of Liability

To the extent permitted by applicable law, the Firm is not liable for indirect, incidental, special, or consequential damages resulting solely from Website use, technical interruptions, or reliance on general informational content. Nothing in these Terms waives claims for legal malpractice, limits nonwaivable rights or remedies, or reduces duties under applicable law or professional-conduct rules. Fees and obligations arising from legal representation are governed by the applicable engagement agreement and law.

15. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless the Firm and its personnel from third-party claims, losses, and reasonable expenses arising from your unlawful use of the Website, infringement of another party’s rights, or material violation of these Terms. This provision does not apply to claims arising from the Firm’s professional negligence, misconduct, or breach of duties owed to a client or prospective client, and does not require indemnification where prohibited by law.

16. Restriction or Termination of Website Access

We may suspend or restrict access to the Website when reasonably necessary to address security threats, misuse, or violations of these Terms. Restricting Website access does not terminate any existing attorney-client relationship or alter obligations concerning client files, communications, or withdrawal from representation.

17. Changes to These Terms

We may revise these Terms from time to time by posting an updated version and effective date. Continued Website use after revised Terms are posted constitutes acceptance to the extent permitted by law. Revisions do not retroactively change an existing engagement agreement or waive applicable professional obligations.

18. Governing Law and Forum

These Terms and disputes arising out of or relating to use of the Website shall be governed by the laws of the State of Georgia, without regard to conflict-of-law principles, except where applicable law requires otherwise. To the extent permitted by law, any lawsuit arising out of or relating to use of the Website or these Terms shall be brought exclusively in a court of competent jurisdiction located in Fayette County, Georgia. If a claim falls within the exclusive jurisdiction of the federal courts, it shall instead be brought in the United States District Court for the Northern District of Georgia, to the extent that court has jurisdiction and venue is proper. The parties consent to personal jurisdiction and venue in the designated courts to the extent permitted by law. This provision does not govern disputes arising from attorney-client representation, does not modify any engagement agreement, and does not require arbitration.

19. Severability and Entire Agreement Regarding Website Use

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain effective to the extent permitted by law. These Terms constitute the agreement regarding general use of the Website, but do not supersede an engagement agreement, applicable professional duties, or separate legally required notices or consents.

20. Privacy and Cookies

Information about collection and use of personal information and cookies will be provided in the Firm’s separate Privacy Policy and Cookie Policy when published. Those policies should be reviewed alongside these Terms; this section does not represent that any particular cookie or privacy control is currently available.

21. Contact
